BOOST BY JOBBER COMPETITION RULES
(the “Official Rules”)

Overview. Octopusapp Inc. operating as Jobber (“Jobber”) wants to challenge aspiring and experienced business owners alike through the “Boost by Jobber” competition (the “Contest”). Contestants will be invited to participate in a four-phase application process:
The Contest will be organized to support business owners at four specific stages: pre-launch, early stage, growth, and COVID-19 support (each a “Category” and together the “Categories”). The top five contestants in each Category will receive a monetary Prize as described in Section 7 below, as well as the chance to be featured on the Jobber website, www.getjobber.com and on the Contest website, www.boostbyjobber.com (the “Contest Website”), social media channels and in various media including videos, podcasts, photographs, printed materials and articles.
In the event that Jobber extends the Phase One submission period, the dates for Phases Two to Four will be updated accordingly so please review any revised version of these Rules the most current version of which will be available on the website, boostbyjobber.com and as indicated by the Last Updated date.
At the end of each Phase, a judging panel convened by Jobber will select the entrants who will proceed to the next Phase. After completion of Phase Four, the jury will make its determination about the winning entries on or about July 23, 2021 and Jobber will attempt to notify the winners by phone or email by August 3, 2021.
Eligibility. The Contest is open to residents of the United States of America and Canada (excluding Quebec) who are over the age of eighteen (18) as of March 23, 2021 and who comply with the entry procedures described in these Official Rules. Only entries submitted by those contestants who have registered through the Contest Website will be accepted. The Contest is not open to immediate family members of Jobber employees or persons residing with employees of Jobber. NO PURCHASE IS NECESSARY.
Submission of Entries. Each contestant may submit only one (1) entry to the Contest on that contetstant’s behalf or on behalf of a named business for which contestant is entering the Contest. Contestants must also submit their name, age (as at March 24, 2021), phone number, email address, and home address (including postal code) along with the name of the contestant’s business. By submitting an entry to the Contest, each contestant agrees to be bound by the terms of these Official Rules. An entry may be rejected if it does not contain all of the required information described in this Section or if the entry does not comply with the requirements set forth in these Official Rules.
Misconduct. Jobber has the right to reject or cancel any and all entries, as determined in Jobber’s sole discretion, that are incomplete or duplicative; that are false or deceptive; that violate any law or regulation; that transmit content that contains any viruses, Trojan Horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; and/or that interfere with or disrupt the Contest or servers or networks connected to the Contest. Jobber shall also be entitled to reject or cancel any entries submitted by anyone who violated these Official Rules..
Grant Awards. Twenty (20) grants will be awarded to the top five entries in each Category with a total amount being given away of USD$100,000. For each Category except COVID-19 Support, t he highest-ranking entry in each Category will receive a larger grant. Award amounts by Category are listed in the table below:

Jobber has the right to substitute prizes of equal or greater value. All federal, provincial, state or other taxes that may apply due to the receipt of a prize are the sole responsibility of the individual who receives that prize. No more than the advertised number of prizes will be awarded and no more than USD$100,000.00 will be paid in aggregate to the winning contestants. Winners will be required to provide copies of government-issued picture identification (such as a driver’s license or passport) to verify identity and validate their compliance with the age requirements of the Contest.
Method of Selecting Winners. Once a contestant has completed and submitted the Phase One online entry form, the contestant will receive an automated confirmation that his or her entry has been received, and an additional invitation on or around the Phase 2 start date if contestant is being invited, based on the Phase One entry, to submit an application for Phase Two. The same process will apply for later phases of the Contest. For each Phase Contest entries will be evaluated as follows:
Submissions will be judged by a panel composed of representatives of Jobber. Judging is at the sole and absolute discretion of the Judges, without right of appeal.

25% – What are the business goals of your business over the next year?
50% – How will the prize help you achieve your goals?
25% – How is your business making an impact in your community?
The odds of winning depend on the number of eligible entries received. If a contestant who has qualified for a prize does not respond within ten (10) business days of Jobber’s initial attempt to contact that person, he or she will be disqualified and the next contestant as determined by jury decision will qualify for the applicable prize. If the first-place contestant is disqualified then the second-place contestant will become eligible for the first place-prize and the second-to-fifth-place prizes will be awarded accordingly. A similar process will be followed if any other prize winner is disqualified. This process will continue until Jobber can successfully award the grand prizes.
LIMITATION OF LIABILITY. BY PARTICIPATING IN THIS CONTEST, EACH CONTESTANT WHO REGISTERS AT THE CONTEST WEBSITE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RELEASES AND HOLDS JOBBER AND ALL OF THE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS OF JOBBER (HEREINAFTER THE “JOBBER INDEMNITEES”), HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, ACTIONS OF ANY KIND IN CONNECTION WITH THE CONTESTANT’S INVOLVEMENT IN THE CONTEST AND/OR IN CONNECTION WITH THE CONTESTANT’S SUBMISSION OF AN ENTRY, ACCEPTANCE, POSSESSION OR USE OF THE PRIZES, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE, AND ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, DISPARAGEMENT, INTELLECTUAL PROPERTY INFRINGEMENT OR MISAPPROPRIATION, OR INVASION OF PRIVACY.
Malfunctions. Jobber Indemnitees are, to the fullest extent permitted by applicable law, not responsible for (i) any entries lost due to technical failures of any kind, including, but not limited to any malfunction, error, omission, interruption, deletion, defect, delay in the operation of any computer, telecommunications, network or Internet hardware or software, or any unavailability or inaccessibility of any transmission facility, telephone, telecommunications or Internet service; (ii) any unauthorized human intervention in any part of the entry process or Contest activities; (iii) any electronic or human error that may occur in the administration of the Contest, the processing of entries, or the selection of the winners; (iv) any injury or damage to persons or property, including, but not limited to a contestant’s computer hardware or software including, without limitation, any damage caused by any computer virus or worm, which may have been caused, directly or indirectly, by participation in the Contest, (v) any incorrect or inaccurate information, whether caused by a contestant or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest, (vi) any theft or destruction or unauthorized access to, or alteration of entries, or (vii) any personal injury or other loss or damage that may be incurred by a contestant or anyone else as a result of the receipt or use of any prize awarded in the Contest. If, for any reason, the Contest is not capable of running as planned by Jobber, including because of any infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Jobber that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, Jobber reserves the right to terminate or modify the Contest. Jobber, in its sole discretion, reserves the right to disqualify any person tampering with the entry or voting process, the operation of the Contest website or who is otherwise in violation of the Official Rules. Jobber reserves the right to modify the Official Rules as Jobber deems necessary to conduct the Contest in a secure, fair and proper manner as intended by Jobber. ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, JOBBER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Publicity. Except where prohibited, submitting a Contest entry constitutes contestant’s consent to Jobber’s use of the contestant’s submission (including any intellectual property belonging to the contestant submitted with that entry) for the purposes of conducting this Contest without further payment or consideration. Winners will be required to sign an affidavit of eligibility and publicity release further granting Jobber the right to use the contestant’s name, image, likeness and biographical materials, as well as the contestant’s business name, logo and description for publicity and promotion purposes including without limitation online announcements without additional compensation, unless prohibited by law. Each contestant hereby grants Jobber an irrevocable, non-exclusive, paid-up, royalty-free, perpetual and worldwide license to reproduce any logos or images submitted by such contestant in any medium (whether now available or hereinafter developed) and to publish, distribute, transmit and otherwise exploit such reproductions in Jobber publications or for any other purposes associated with the Contest. Jobber shall have the right to edit the size of digital images submitted by contestants as Jobber chooses for the forgoing permitted purposes.
Governing Law. By submitting an entry to the Contest website, each contestant accepts and agrees to be bound by these Official Rules. All decisions of Jobber with respect to any aspect of the Contest and these Official Rules, including, without limitation, the eligibility of entries, the entries selected for each phase, and the winners are final and binding on all contestants. The laws of the Province of Alberta, excluding its provisions on conflict of laws, shall govern this Contest. Each entrant hereto irrevocably submits to the exclusive jurisdiction of the Provincial and the Federal Courts in Edmonton, Alberta with respect to any matter arising hereunder or related hereto. These Official Rules state all of the terms and conditions governing the Contest.
