Jobber Grants Program Rules
(the "Official Rules")

1. Overview

Octopusapp Inc. operating as Jobber (“Jobber”) wants to challenge aspiring and experienced business owners alike by encouraging them to apply for the “Jobber Grants” program (the “Program”). Applicants will be invited to participate in a three-phase application process:

  • Phase One – an introductory survey

  • Phase Two – a detailed questionnaire

  • Phase Three – application scoring and a phone and/or video interview with finalists (each a “Phase” and together the “Phases”).

    Fifteen (15) selected applicants who meet the eligibility requirements set out herein, as determined by Jobber in its discretion, will receive a monetary grant as described in Section 7 below, as well as the chance to be featured on the Jobber website, www.getjobber.com and on the Program website, https://getjobber.com/grants, (the “Program Website”), social media channels and in various media including videos, podcasts, photographs, printed materials and articles.

2. Key Dates

In the event that Jobber extends the Phase One submission period, the dates for Phases Two and Three will be updated accordingly. Therefore, prior to making any submissions please regularly check and review any revised version of these Official Rules the most current version of which will be available on the Program Website, https://getjobber.com/grants, and as indicated by the Last Updated date.

  • Phase One of the Program will be open to submissions at 8:00 a.m. Mountain Time (MT) on March 6, 2024, and will close at 5:59 p.m. MT on June 12, 2024. Applicants can visit the Program Website to enter and submit their Phase One survey. Unless the Phase One submission period is extended by Jobber, in Jobber’s sole discretion, through a published update to these Official Rules, no entries will be accepted after 5:59 p.m. MT on June 12, 2024.

  • Phase Two of the Program will occur between approximately 7:00 a.m. MT on June 18, 2024 to 5:59 p.m. MT on June 26, 2024. Eligible applicants will receive an email from Jobber with the detailed questionnaire or application on June 18, 2024 and have until 5:59 p.m. MT on June 26, 2024 to complete the questionnaire or application, as applicable.

  • Phase Three of the Program will occur between 12:00 a.m. MT on July 8, 2024 to 11:59 p.m. MT on July 19, 2024.

At the end of each Phase, a judging panel convened by Jobber will select the applicants who will proceed to the next Phase. After completion of Phase Three, the panel will make its determination about the winning entries on or about July 15, 2024 and Jobber will attempt to notify the recipients by phone or email by July 31, 2024.

3. Eligibility

The Program is open to residents of the United States of America and Canada (excluding Quebec) who are over the age of eighteen (18) as of March 6, 2024 and who comply with the entry procedures described in these Official Rules. Only entries submitted by those applicants who have registered through the Program Website will be accepted. Employees, officers, directors, agents, and representatives of Jobber, their parent and affiliated companies, the Program prize suppliers, the Program judges (if applicable), and any and all other companies associated with the Program, as well as those with whom the foregoing individuals reside, are not eligible to enter this Program. The Program is NOT open to employees of Jobber, or any of their respective affiliated companies, advertising or promotional agencies, or anyone domiciled with any such employee. NO PURCHASE IS NECESSARY.

4. Submission of Entries

Each applicant may submit only one (1) entry to the Program on that applicant's behalf or on behalf of a named business for which applicant is entering the Program. Applicants must also submit their name, phone number, email address, and home address (including postal code) along with the name of the applicant’s business. By submitting an entry to the Program, each applicant agrees to be bound by the terms of these Official Rules. An entry may be rejected if it does not contain all of the required information described in this Section or if the entry does not comply with the requirements set forth in these Official Rules.

5. Conduct

Applicants, grant recipients and their employees and representatives shall at all times conduct themselves with regard for public decency and compliance with applicable laws and shall not commit an act or do anything that brings themselves or Jobber into public disrepute, scandal or ridicule or which insults or offends the community or which injures the success of Jobber or its products or services. At the time of any such acts or at any time after Jobber learns of such acts Jobber shall have the right, in addition to any equitable or legal remedies, including injunctive relief, to immediately terminate applicant or grant recipient's participation in the Program and revoke applicant or grant recipient's eligibility immediately and rescind or refuse to award any grants as determined in Jobber's absolute discretion. Jobber may seek financial remedies or indemnification related to the offending conduct.

6. Grant Awards

Fifteen (15) grants of USD$10,000 each will be awarded with a collective amount of grants available to be awarded under the Program totalling USD$150,000.

Jobber has the right to substitute grants of equal or greater value or add additional grants to the Program. All federal, provincial, state, local or other taxes that may apply due to the receipt of a grant are the sole responsibility of the individual or company who receives that grant. No more than the advertised number of grants will be awarded and no more than USD$150,000.00 will be paid in aggregate to the winning applicants unless otherwise expressly stated by Jobber in writing. recipients will be required to provide copies of government-issued picture identification (such as a driver’s license or passport) to verify identity and validate their compliance with the age requirements of the Program, as well as tax ID information, social security or social insurance numbers, and completed affidavits to allow Jobber to (among other things) use recipient names, images, statements, and other relevant information for social media and publicity of Jobber Grants.

7. Method of Selecting Grant Winners

Once an applicant has completed and submitted the Phase One online entry form, the applicant will receive an automated confirmation that their entry has been received. If applicant qualifies as determined by Jobber in its discretion based on applicant’s Phase One entry, applicant may, in Jobber’s discretion, receive an additional invitation on or around the Phase Two start date to submit a questionnaire or application for Phase Two. If applicant qualifies as determined by Jobber in its discretion based on applicant’s Phase Two entry, applicant may, in Jobber’s discretion, receive an additional invitation on or around the Phase Three start date to undergo an interview for Phase Three.

The Program grants support the home service sector specifically, so Jobber will be only selecting “home service businesses” as grant recipients. Home service businesses provide a one-time or recurring install, repair, maintenance, or mobile services to clients at residential or commercial properties. A non-exhaustive list of examples includes: landscaping, residential and commercial cleaning, contracting, painting, HVAC, plumbing, pool maintenance, and mobile car detailing.

Home-based or retail businesses that primarily sell or provide goods and services online, from home, or from brick-and-mortar locations are not eligible.

Submissions will be judged by a panel composed of representatives of Jobber. Judging is at the sole and absolute discretion of the judges, without right of appeal.

Judging Criteria & Weighting

Approximately 25% - Your business goals over the next year and how funding will be used to support them.

Approximately 75% - Going above and beyond in one or more areas:

  • Keeping homes and offices safe and running smoothly

  • Helping hardworking people build meaningful careers

  • Striving for high standards in every area of your business

  • Giving back to the communities where they live and work

If an applicant who has qualified for a grant does not respond within ten (10) business days of Jobber’s initial attempt to contact that person, they will be disqualified and the next applicant as determined by the panel’s decision will qualify for the applicable grant. A similar process will be followed if any other grant recipient is disqualified. This process will continue until Jobber can successfully award the applicable grant or grants.

8. Limitation of Liability

BY PARTICIPATING IN THIS PROGRAM, EACH APPLICANT WHO REGISTERS ON THE PROGRAM WEBSITE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RELEASES AND HOLDS JOBBER AND ALL OF THE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS OF JOBBER (HEREINAFTER THE “JOBBER INDEMNITEES”), HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, ACTIONS OF ANY KIND IN CONNECTION WITH THE APPLICANT’S INVOLVEMENT IN THE PROGRAM AND/OR IN CONNECTION WITH THE APPLICANT’S SUBMISSION OF AN ENTRY, ACCEPTANCE, POSSESSION OR USE OF THE GRANTS, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE, AND ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, DISPARAGEMENT, INTELLECTUAL PROPERTY INFRINGEMENT OR MISAPPROPRIATION, OR INVASION OF PRIVACY.

9. Malfunctions

Jobber Indemnitees are, to the fullest extent permitted by applicable law, not responsible for: (i) any entries lost due to technical failures of any kind, including, but not limited to any malfunction, error, omission, interruption, deletion, defect, delay in the operation of any computer, telecommunications, network or Internet hardware or software, or any unavailability or inaccessibility of any transmission facility, telephone, telecommunications or Internet service; (ii) any unauthorized human intervention in any part of the entry process or Program activities; (iii) any electronic or human error that may occur in the administration of the Program, the processing of entries, or the selection of the recipients; (iv) any injury or damage to persons or property, including, but not limited to an applicant’s computer hardware or software including, without limitation, any damage caused by any computer virus or worm, which may have been caused, directly or indirectly, by participation in the Program, (v) any incorrect or inaccurate information, whether caused by an applicant or by any of the equipment or programming associated with or utilized in the Program or by any technical or human error which may occur in the processing of submissions in the Program, (vi) any theft or destruction or unauthorized access to, or alteration of entries, or (vii) any personal injury or other loss or damage that may be incurred by an applicant or anyone else as a result of the receipt or use of any grant awarded in the Program. If, for any reason, the Program is not capable of running as planned by Jobber, including because of any infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Jobber that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Program, Jobber reserves the right to terminate or modify the Program. Jobber, in its sole discretion, reserves the right to disqualify any person tampering with the entry or voting process, the operation of the Program website or who is otherwise in violation of the Official Rules. Jobber reserves the right to modify the Official Rules as Jobber deems necessary to conduct the Program in a secure, fair and proper manner as intended by Jobber. ANY ATTEMPT TO DELIBERATELY DAMAGE THE PROGRAM WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, JOBBER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Privacy

Applicant information submitted as part of the registration process will be collected in accordance with Jobber’s privacy policy subject to any publicity rights granted by the winning applicants to Jobber. Applicants acknowledge that certain information submitted by them will be used as part of the Program and made publicly accessible, including on the Program website during the phases and by Jobber to identify the applicants.

11. Publicity

Except where prohibited, submitting a Program entry constitutes applicant’s consent to Jobber’s use of the applicant’s submission (including any intellectual property belonging to the applicant submitted with that entry) for the purposes of conducting this Program without further payment or consideration. Winners will be required to sign an affidavit of eligibility and publicity release further granting Jobber the right to use the applicant’s name, image, likeness and biographical materials, as well as the applicant’s business name, logo and description for publicity and promotion purposes including without limitation online announcements without additional compensation, unless prohibited by law. Each applicant hereby grants Jobber an irrevocable, non-exclusive, paid-up, royalty-free, perpetual and worldwide license to reproduce any logos or images submitted by such applicant in any medium (whether now available or hereinafter developed) and to publish, distribute, transmit and otherwise exploit such reproductions in Jobber publications or for any other purposes associated with the Program. Jobber shall have the right to edit the size of digital images submitted by applicants as Jobber chooses for the forgoing permitted purposes.

12. Interim Reporting Requirement

Grant recipients agree to provide interim reports on the impact of the grant funds on their business, as may be further detailed in the applicable affidavit of eligibility and publicity release. Failure to provide timely and accurate interim reports as required by Jobber may result in the revocation of the grant award.

13. Governing Law

By submitting an entry to the Program website, each applicant accepts and agrees to be bound by these Official Rules. All decisions of Jobber with respect to any aspect of the Program and these Official Rules, including, without limitation, the eligibility of entries, the entries selected for each phase, and the winners are final and binding on all applicants. The laws of the Province of Alberta, excluding its provisions on conflict of laws, shall govern this Program. Each entrant hereto irrevocably submits to the exclusive jurisdiction of the Provincial and the Federal Courts in Edmonton, Alberta with respect to any matter arising hereunder or related hereto. These Official Rules state all of the terms and conditions governing the Program.
